Alimony §61.08, Fla. Stat. Part 5 of 9 | Divorce Attorney Fort Myers/Cape Coral
In a proceeding for dissolution of marriage, the court may grant alimony to either party, which alimony may be bridge-the-gap, rehabilitative, durational, or permanent in nature or any combination of these forms of alimony. In any award of alimony, the court may order periodic payments or payments in lump sum or both. The court may consider the adultery of either spouse and the circumstances thereof in determining the amount of alimony, if any, to be awarded.
Below please find some general information regarding Alimony and how it is awarded.
E. Temporary Support
- Pursuant to Fla. Stat. §61.071, temporary alimony may be awarded to either spouse upon a well-founded request while a dissolution of marriage action is pending.
- Even a spouse in a short-term marriage can be awarded temporary alimony as the factor of a short-term marriage, standing alone, could not justify the denial of temporary relief. Littlejohn v. Littlejohn, 495 So.2d 271, 272 (Fla. 2d DCA 1986)
- Temporary relief orders are among the areas where trial judges have the very broadest discretion, which appellate courts are very reluctant to interfere with absent the most compelling of circumstances.
- Section 61.14(11) (a) provides that a court may, upon good cause shown, and without a showing of a substantial change in circumstances, modify, vacate, or set aside a temporary support order before or upon entering a final order in a proceeding. For more information, please contact us to schedule your consultation.
