Lump Sum Monetary Payment for Equitable Distribution
- To do equity between the parties, the court may, in lieu of or to supplement, facilitate, or effectuate the equitable division of marital assets and liabilities, order a monetary payment in a lump sum or in installments paid over a fixed period of time.
- When making a lump sum distribution, the trial court may consider all assets and income available to a party. Monas v. Monas, 665 So.2d 346 (Fla. 4th DCA 1995).
- Long Term Installment Plans. Marital Home. Installment scenario which spans twenty years effectively deprives the former spouse of his present one-half interest in the marital home. Evans v. Evans, 128 So.3d 972 (Fla. 1st DCA 2013).
