If either of those things happens then we have to file the Affidavit of Diligent Search stating to the court that we did everything we could to locate the spouse, meaning we did a public records search, we contact former contact phone numbers or former addresses. Then once we do so, then we will notice them via publication. We would be putting it in a publication via the newspaper for four consecutive weeks. After those four consecutive weeks, if there is no response, then we will ask the court to issue a default in the case. Once the court issues a default, then we will set the case for trial and have the court issue a final judgment in the matter.
