How child support is calculated can be tedious and complicated. In Florida, once paternity/maternity has been established, each party must file a parenting plan and financial affidavit. These two documents are then used to complete a child support guidelines worksheet. The child support guidelines worksheet is the document that the Court utilizes to order the payment of child support. Below is a brief explanation of each of the documents:
Parenting Plan: Parenting plans are used to help the Court determine time-sharing between the parties. The parties may complete a joint parenting plan or they may submit their own separate plans. In the event the parties submit separate plans, they will be asked to try to come up with a joint plan. If the parties cannot agree on a joint parenting plan the Court will decide who gets the child and for how much time. The Court makes its determination by looking at what is in the best interest of the child.
Financial Affidavits: A financial affidavit requires each party to declare their monthly income/expenses and any assets/liabilities they may have. Each party must also provide the other with mandatory disclosures documents. These are essentially financial documents such as bank statements, loan documents and tax returns.
Child Support Guidelines Worksheet: After each party receives each others proposed parenting plan, financial affidavits and mandatory disclosures documents, a child support guidelines worksheet can be calculated. The child support guidelines worksheet takes into account several different factors including each parent’s monthly income, the amount of time each parent spends with the child, and the expenses of the child. Once all of the information in plugged into the worksheet, the amount of support each parent should pay is determined. That number is the number the Court uses to order child support.
