Yes, it’s one of the several factors that the court takes into consideration, but before doing so, there has to be a finding by the court to allow the child to testify. However, it’s one of those areas that we do not like to go into because if we feel it’s in the best interest of the child not to get them involved in this matter because it is already a trying time, very emotionally-driven time, and having the child involved in the proceeding is something that could affect them down the line that you may not even be aware of.
